1. Acceptance of Terms

By accessing or using Bohudur ("the Service," "the Platform," "we," "us," or "our") at bohudur.one or any of its subdomains, including console.bohudur.one and docs.bohudur.one, you ("User," "you") agree to be bound by these Terms and Conditions ("Terms") and our Privacy Policy, which is incorporated herein by reference.

If you are using Bohudur on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.

2. Description of Service

Bohudur is a free, personal payment automation platform that enables developers and businesses to integrate Bangladeshi mobile financial services (MFS) — including bKash, Nagad, Rocket, and Upay — as well as global gateways such as Stripe and PayPal, into their applications and websites.

The core features of Bohudur include:

• Payment verification and automation via a background mobile app
• A developer API and PHP SDK for website and app integration
• An online console (dashboard) for viewing and managing transactions
• HTTP webhook delivery for real-time payment event notifications
• Automated PDF receipt generation
• Payment link generation
• Currency conversion tools

Bohudur is provided free of charge. We reserve the right to introduce optional paid features or tiers in the future, with advance notice to users.

3. Eligibility

To use Bohudur, you must:

• Be at least 13 years of age (or the minimum age of digital consent in your jurisdiction)
• Have the legal capacity to enter into a binding contract
• Not be prohibited from using the service under the laws of your applicable jurisdiction

You do not need a trade license, business registration, or any formal financial certification to use Bohudur. It is open to individual users, developers, and organizations.

4. Account Registration and Security

4.1 Registration

To access the Bohudur Console, you must sign in using a valid Google account. By doing so, you grant Bohudur permission to access your name, email address, and profile picture as provided by Google.

4.2 Account Responsibility

You are solely responsible for:

• Maintaining the confidentiality of your account credentials and API keys
• All activity that occurs under your account
• Promptly notifying us at contact@bohudur.one if you suspect unauthorized use of your account

Bohudur is not liable for any loss or damage arising from your failure to maintain account security.

4.3 API Keys

Your API key is confidential. Do not expose it in client-side code, public repositories, or any publicly accessible location. If your API key is compromised, you must immediately regenerate it from the Console.

5. Acceptable Use Policy

You agree to use Bohudur only for lawful purposes and in a manner consistent with these Terms. You must not use the platform to:

• Process payments for illegal goods or services, including but not limited to narcotics, weapons, or counterfeit products
• Engage in money laundering, fraud, or any other financial crime
• Impersonate another person or entity, or misrepresent your identity
• Violate the terms of service of any integrated payment provider (bKash, Nagad, Rocket, Stripe, PayPal, etc.)
• Conduct phishing, scamming, or any form of social engineering against users
• Distribute malware, spam, or any malicious code via webhooks or API integrations
• Attempt to gain unauthorized access to Bohudur's systems, databases, or other users' accounts
• Reverse engineer, decompile, or attempt to extract the source code of Bohudur's proprietary systems
• Resell or sublicense access to the Bohudur API or platform without prior written consent
• Use the platform in any way that could damage, disable, overburden, or impair Bohudur's infrastructure

We reserve the right to suspend or terminate accounts that violate this policy without prior notice.

6. API Usage and Limits

Access to the Bohudur API is provided free of charge, subject to the following conditions:

• You must use the API in accordance with Bohudur's Documentation
• You must not use the API in a way that places an unreasonable load on our servers
• Rate limits may be enforced to ensure fair usage for all users; you will be notified if limits apply
• Bohudur reserves the right to throttle or suspend API access in cases of abuse or excessive load

We may introduce API versioning or deprecation policies in the future. We will provide reasonable advance notice before deprecating any API version.

7. Payments and Transactions

7.1 No Storage of Banking Credentials

Bohudur does not store, process, or have access to your mobile banking PIN, password, or full account number. Payment automation works by reading transaction confirmation notifications delivered to your registered device. You remain fully in control of your banking account.

7.2 Transaction Verification

Bohudur provides a payment verification layer between your users and your application. While we strive for accuracy, Bohudur does not guarantee the correctness or completeness of any payment data received from third-party mobile financial services.

7.3 Disputes

Bohudur is not a party to any transaction between you and your end users. Any payment disputes, refunds, or chargebacks are solely between you, your users, and the respective payment gateway. We do not mediate financial disputes.

7.4 No Financial Services

Bohudur is a software automation tool, not a licensed financial institution, payment processor, or money service business. We do not hold, transfer, or settle funds on your behalf.

8. Intellectual Property

8.1 Bohudur's Intellectual Property

All content, code, design, trademarks, logos, and software comprising the Bohudur platform are the exclusive property of Bohudur and its licensors. You may not reproduce, distribute, modify, or create derivative works from any Bohudur materials without explicit written permission.

8.2 Your Content

You retain ownership of any content, data, or code you develop using the Bohudur API. By using the Service, you grant Bohudur a limited, non-exclusive license to use your data solely for the purpose of providing and improving the Service.

8.3 Open Source

Certain components of Bohudur may be released under open-source licenses. Where applicable, those licenses govern the use of those specific components.

9. Disclaimers and Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, BOHUDUR EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

• Implied warranties of merchantability, fitness for a particular purpose, and non-infringement
• Guarantees of uninterrupted, error-free, or secure operation of the platform
• Accuracy or completeness of any payment data, notifications, or reports
• The continued availability of any third-party payment gateway or integration

We do not warrant that Bohudur will meet your specific requirements or that any errors in the platform will be corrected.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BOHUDUR AND ITS TEAM MEMBERS, CONTRIBUTORS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY:

• Indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, goodwill, or business opportunities
• Damages resulting from unauthorized access to or alteration of your data
• Damages arising from your use or inability to use the Service
• Damages caused by third-party payment gateways, mobile banking services, or network interruptions

In jurisdictions that do not allow the exclusion of certain warranties or limitation of liability, Bohudur's liability is limited to the maximum extent permitted by law.

11. Indemnification

You agree to indemnify, defend, and hold harmless Bohudur and its contributors from and against any claims, liabilities, damages, losses, and expenses — including reasonable legal fees — arising out of or in connection with:

• Your use or misuse of the Service
• Your violation of these Terms
• Your violation of any applicable law or regulation
• Any dispute between you and your end users regarding payment transactions
• Your infringement of any third-party rights

12. Termination

12.1 Termination by You

You may stop using Bohudur and delete your account at any time via the Console. Termination does not entitle you to any refund, as the Service is provided free of charge.

12.2 Termination by Bohudur

We reserve the right to suspend or permanently terminate your access to Bohudur — with or without notice — if we determine that you have:

• Violated these Terms or our Acceptable Use Policy
• Engaged in fraudulent, illegal, or harmful activity
• Placed an unreasonable burden on our infrastructure

12.3 Effect of Termination

Upon termination, your right to use the Service immediately ceases. Provisions of these Terms that by their nature should survive termination will continue in effect, including Sections 8 (Intellectual Property), 9 (Disclaimers), 10 (Limitation of Liability), and 11 (Indemnification).

13. Third-Party Services

Bohudur integrates with third-party services including bKash, Nagad, Rocket, Upay, SSL Commerz, Stripe, PayPal, and Google. Your use of these services is governed by their respective terms of service and privacy policies. Bohudur is not responsible for the availability, accuracy, or conduct of any third-party service.

Links to external websites or services found within Bohudur do not constitute endorsement of those services.

14. Changes to Terms

Bohudur may revise these Terms at any time. When we make material changes, we will update the "Last Updated" date at the top of this page. For significant changes, we may also notify you via email or a notice on the platform.

Your continued use of Bohudur following the posting of revised Terms signifies your acceptance of those changes. If you do not agree with any revision, you must stop using the Service.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Bangladesh, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the competent courts of Bangladesh.

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining Terms remain in full force and effect.
